Federal prosecutors charged Sean Dunn recently accused of throwing a sandwich at a Customs and Border Patrol agent in Washington, D.C., with a misdemeanor after a grand jury refused to indict him on Wednesday for a felony assault charge, court records show.

Prosecutors were not able to convince a grand jury to charge Dunn with the more serious offense, according to sources cited in an ABC News report.
