Costco is the latest of more than a dozen companies to have sued the Trump administration seeking refunds for what they say the president’s tariff policies have cost them. Currently, the question of the legality of President Donald Trump’s “reciprocal” tariffs on foreign trade partners is being challenged at the Supreme Court.
“The United States will no longer put itself last on matters of international trade in exchange for empty promises,” the White House wrote last April in a release on new trade policies.
The question before the High Court involves Trump’s use of the International Emergency Economic Powers Act (IEEPA), according to The Hill.
The companies have challenged the tariffs in the U.S. Court of International Trade. According to Costco’s attorney in its lawsuit against the administration, “Because IEEPA does not clearly authorize the President to set tariffs … the Challenged Tariff Orders cannot stand and the defendants are not authorized to implement and collect them.”
Among the more than companies that have sued the administration are several Toyota subsidiaries, Revlon and Bumble Bee Foods.
