The Justice Department on Tuesday moved to dismiss a records lawsuit that the Biden administration brought against President Donald Trump’s adviser Peter Navarro.
The Biden administration filed the lawsuit in 2022, which requested Navarro release private emails he sent during his time in the first Trump administration, stating he was required to produce the emails under the Presidential Records Act.
The DOJ did not specify a reason for the dismissal in a brief court filing, but moved to dismiss it with prejudice, which means it cannot be brought up against the adviser again.
The Biden administration argued Navarro was subject to the Presidential Records Act as a White House official in the first administration, which requires all records that were transmitted in an official capacity to be turned over to the National Archives and Records Administration at the end of a presidential term.
The National Archives was made aware that it didn’t possess the emails after an investigation by the House Select Subcommittee on the Coronavirus Crisis.
