
Kentucky is going to stop offering in-state tuition to illegal immigrants at public colleges and universities after a lawsuit brought by Attorney General Pam Bondi, according to to Kentucky Attorney General Russell Coleman.
Coleman told Fox News Digital that the policy was changed about two months after the U.S. Justice Department sued over its state law 13 KAR 2:045.Â
Foreign students who legally obtain student visas are required to pay out-of-state tuition in states such as Kentucky.
The lawsuit argued that Kentucky’s policy to allow illegal immigrants to pay in-state tuition was a violation of 18 USC 1623, which states that “notwithstanding any other provision of law, an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a state for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit … without regard to whether the citizen or national is such a resident.”
