SCOTUS rules Trump can remove three Democrats from Consumer Product Safety Commission

The Supreme Court on Wednesday ruled in an emergency appeal that President Donald Trump can remove three Democrat members of the Consumer Product Safety Commission, who were dismissed by Trump but reinstated by a judge.

The six conservative justices agreed with the Justice Department that the commission is under the president’s control as the leader of the executive branch and that the president does not need cause to dismiss commissioners. All three liberal justices dissented.

U.S. District Judge Matthew Maddox in Baltimore ruled last month that the removals were unlawful. The commission helps protect consumers from dangerous products by issuing recalls and suing companies, the Associated Press reported.

The ruling comes after the Supreme Court previously allowed Trump to fire members of the National Labor Relations Board and the Merit Systems Protection Board on the same premise, that the boards fall under his control.

The Supreme Court is currently on its annual summer break, though can weigh in on emergency orders, and will return to a full schedule in October.
